# Terms of Service

These Terms of Service ("Terms") govern visits to https://harborhue.shop, use of its store functions, and orders placed with harborhue (collectively, the "Services"). harborhue is operated by ARZA NATHANAEL LLC ("we," "our," or "us"). By using the Services or placing an order, you accept these Terms and the policies they reference. Do not use the Services if you do not agree.

## 1. Customer Eligibility

You must have legal capacity to enter into a contract where you reside. Anyone who has not reached the applicable age of majority may use the Services only with the authorization and supervision of a parent or guardian.

Account and checkout information must be accurate and complete. If an account is created, you must protect the password and inform us promptly of suspected unauthorized use. Responsibility for activity does not extend to a security failure caused by us.

## 2. Lawful Use

The Services may be used for ordinary personal shopping and purposes we otherwise authorize. You must not:

- submit a fraudulent order, use an unauthorized payment method, or impersonate someone else;
- violate a law or another person's intellectual property, privacy, or other rights;
- introduce malware, disrupt operation, defeat access controls, or probe security without permission;
- extract store data through unauthorized automated collection;
- transmit threatening, abusive, deceptive, or unlawful material; or
- copy, resell, or commercially exploit the Services or their content without written authorization.

We may refuse access or activity that reasonably presents a legal, fraud, safety, or security risk. Mandatory customer protections remain unaffected.

## 3. Product Listings

We take reasonable steps to provide accurate photographs, specifications, measurements, colors, availability, and descriptions. Colors and appearance can vary by screen, and ordinary manufacturing variation may occur. This does not affect remedies when a product is faulty, not as described, or does not meet a legally protected purpose.

Inventory and product ranges can change. Adding merchandise to a cart does not reserve it. Reasonable quantity limits may be applied per customer, account, household, delivery address, payment method, or order to protect stock availability and prevent abuse or unauthorized resale.

## 4. Prices, Shipping Charges, and Taxes

The checkout identifies the applicable price and currency before payment authorization. The accepted order price does not change merely because a different price is later displayed. Clear listing mistakes are addressed in Section 12.

For an address we accept, the checkout total is intended to include applicable taxes and import duties. harborhue does not require a customer to pay an additional tax or import-duty charge upon delivery. Standard shipping is free for a discounted subtotal greater than US$30. For US$30 or less, the shipping cost is disclosed at checkout. Any optional upgraded delivery service and fee will also appear before payment.

You represent that you are authorized to use the selected payment method and authorize us and the payment provider to process the charge. The payment provider's own conditions may also apply.

## 5. Submission and Acceptance of Orders

An electronic acknowledgment confirms that the order reached our system; it does not necessarily mean we accepted it. Acceptance occurs when we issue a dispatch notice or another express acceptance message.

Before acceptance, we may decline or cancel for a legitimate reason, such as unavailable stock, unsuccessful payment verification, suspected fraud, a delivery restriction, a legal prohibition, or an obvious price or description error. If funds have already been captured, they will be refunded to the method charged.

Review the order and shipping address carefully before submission. Corrections should be emailed immediately to lilietomoth@outlook.com. We will try to make the change but cannot guarantee it after fulfillment begins.

## 6. Dispatch and Delivery

Our Shipping Policy is incorporated into these Terms. We normally process an order in 2-3 business days. After dispatch, standard transit is estimated at 20-45 calendar days. The estimated period can be affected by customs, weather, carrier capacity, holidays, remote service areas, and events outside reasonable control.

Unless the law provides otherwise, risk for a consumer purchase transfers upon delivery to the customer or a person designated by the customer. Ownership transfers once both payment in full and delivery have occurred.

## 7. Returns, Cancellations, and Refunds

The Return and Refund Policy is part of these Terms. It permits free returns of eligible merchandise when the request is made within 30 days after delivery. Approved refunds are issued to the original payment method and generally post within 3-7 business days after issuance, depending on the financial institution.

Eligibility, exclusions, prepaid labels, exchanges, and remedies for faulty or incorrect goods are detailed in that separate policy. No provision limits a cancellation or product remedy that cannot be excluded by law.

## 8. Promotions

An offer may be subject to additional conditions displayed with it. Unless we state differently, promotional codes are not cash, cannot be combined, and must be applied before their expiration. We may withdraw or fix a promotion created or applied in error, but will not unfairly change an offer after accepting the related order.

## 9. Reviews and Submissions

You retain ownership of a review, image, suggestion, or other content submitted to us. You give ARZA NATHANAEL LLC a non-exclusive, worldwide, royalty-free permission to store, reproduce, format, publish, display, and use the submission to operate and promote harborhue. The permission ends when the submission is removed from active systems, except for lawful backup retention and distributed materials that cannot reasonably be recalled.

You must have the necessary rights to submit the material. It must be truthful, lawful, and free of content that infringes rights, discloses private information, or abuses another person. We may moderate or remove a submission that does not meet these standards.

## 10. Intellectual Property Ownership

Website design, original written material, graphics, photographs, logos, and software are owned by or licensed to ARZA NATHANAEL LLC and protected by law. We give visitors a limited, revocable, non-transferable right to access them for personal shopping. No intellectual property ownership is transferred.

Marks and content belonging to manufacturers, Shopify, or other third parties remain the property of those parties. Their appearance on the website does not imply endorsement unless expressly indicated.

## 11. Service Providers and Links

Shopify provides our commerce platform. Other organizations may supply payments, applications, analytics, fulfillment, or carrier services. Direct use of a third-party feature may also be subject to its terms and privacy notice. We do not control independent websites linked from harborhue, but this does not reduce any legal responsibility we have for a provider acting on our behalf.

## 12. Corrections

Store content may occasionally contain an omission, typographical mistake, incorrect description, or inaccurate availability or price. We can update information and correct an error. If a material error affects an order already submitted, we will describe the correction and allow the customer to accept it or cancel for a full refund. A minor mistake will not be used to avoid a valid accepted purchase.

## 13. Personal Information

The Privacy Policy is incorporated into these Terms and describes our handling of personal information, including cookies, disclosures, retention, and privacy requests.

## 14. Warranties and Availability

To the extent permitted by law, the website is made available without a guarantee of continuous, uninterrupted, or error-free access. Merchandise remains subject to its stated description and any express warranty, as well as implied warranties and consumer guarantees that applicable law requires.

Nothing in these Terms excludes a statutory warranty or remedy that cannot be excluded. A restriction applies only to the extent it is valid in the customer's jurisdiction.

## 15. Limits on Liability

To the maximum lawful extent, neither party is liable to the other for indirect, incidental, special, or consequential loss that the parties could not reasonably foresee when the contract was made. Our aggregate contractual liability for a product claim will not be less than the remedy required by law and otherwise will not exceed the amount paid for the affected product.

These Terms do not exclude liability for fraud, fraudulent misrepresentation, intentional misconduct, death or personal injury caused by negligence, breach of mandatory consumer law, or another responsibility that cannot lawfully be excluded or limited.

## 16. Customer-Caused Loss

Where the law permits, a customer must reimburse reasonable and direct losses caused by their unlawful use, material breach of these Terms, or infringement of another person's rights. This provision does not cover loss caused by us and does not displace consumer protections.

## 17. Suspension or Closure

You may discontinue use at any time. We may suspend an account or access when reasonably required to address a serious violation, fraud, security threat, or legal direction. Provisions intended by their nature to continue, including those concerning payment, intellectual property, liability, and disputes, survive.

## 18. Governing Law and Concerns

These Terms are governed by Wyoming law and applicable U.S. federal law, without applying conflict-of-law rules. A consumer does not lose mandatory protections available under the law of the consumer's usual residence.

Email lilietomoth@outlook.com before bringing a formal claim, describing the issue and relevant order number. Both sides will attempt a good-faith informal resolution. This request does not prevent either side from accessing a court, regulator, or consumer remedy available under applicable law.

## 19. General Provisions

These Terms and incorporated policies form the agreement relating to store use and purchases. If a court finds one provision unenforceable, that provision will be limited only as necessary and the rest will remain effective. Delay in enforcement is not a waiver. You may not transfer this agreement without our consent. We may transfer it as part of a legitimate financing, restructuring, or sale provided customer rights are not reduced.

## 20. Amendments

We may revise these Terms to reflect changes in the Services, business, or law. A revised version applies prospectively after publication, except where law requires otherwise. The version effective when an order is accepted continues to govern that order.
